On that day ground breaking for Tom Mannausa’s $50 million luxury mixed use high rise, The Jewel, unassumingly took place. Many doubted. Many didn’t believe. I heard some of them. All the while Tom Mannausa diligently kept playing chess, moving through the myriad of hurdles and permits. Getting to know him, I never doubted his ability to bring his vision to reality. The Jewel is funded with cash to maintain a debt free project through construction of its skeleton and completion of the exterior. That’s a huge war chest. The Vue, ONE88, Sansara, Aqua. All of the developers behind these projects visited Tom and sought his outlook on sales and market conditions, as well as why The Jewel was so successful from a design standpoint. If there was ever any doubt in Tom’s mind about The Jewel, would those meetings have taken place? The Jewel was the catalyst that sparked these other developments. THE JEWEL RISING INTERVIEW WITH DEVELOPER TOM MANNAUSA

Tom, you opened The Jewel’s sales office in November, 2012. In December, 2013 you began converting deposits into binding purchase agreements. During the same timeframe you had to deal with permits and other legal hurdles. Construction began in April, 2014. The Jewel’s residents are slated to move in early August, 2015. What a ride, and the most satisfying part is only beginning. Let’s reflect. WHAT POSSESSED YOU TO COME UP WITH THE IDEA TO CONSTRUCT THE JEWEL? I was watching that block since 1989 when my 5th floor office in Palm Tower over looked it. I knew of two other developers who tried to assemble the block to no avail. When the end cap parcel with the view came on the market I thought about it for a week wondering if I wanted to commit five years of my life to a new condominium development. They are one of the more difficult development types to undertake, due to the fact you must have so many components confirmed and most all loose ends tied up before you can pursue construction and completion. So I went ahead and proceeded. WHAT DO YOU ATTRIBUTE SUCCESS OF THE JEWEL TO?

The first was being able to successfully assemble and purchase the property, ending up with sparkling views and a brilliant location. Without that you can dream all you want. Immediately after land acquisition was secured we moved forward with design. I spent many hours with Kurt Lucas and Gary Hoyt designing and costing out beautiful finishes. Ultimately, the success is truly based upon The Jewel’s customers who desire new crisp modern condominium housing with a full array of amenities and the ability to walk versus drive to so many downtown venues. CAN YOU BRIEFLY ELABORATE ON THE STEPS REQUIRED TO NAVIGATE A PROJECT LIKE THIS? I like to explain that a condominium development looks like a clock with the very center being start, but instead of 12 numbers around the perimeter there are 30 arms of the clock coming to the center. They all move at different speeds and when all 30 reach the center you can start construction. These 30 arms take time to synchronize. So quite honestly selling out,

permitting and starting construction in two years seems reasonable to me. WHAT WAS THE MOST FRUSTRATING PART OF GETTING TO CONSTRUCTION? Finding people who truly wanted to work hard and dedicate themselves to a new project, period. Through an intensive selection process we picked the best experts in their respective fields dedicated to move forward and complete the project. WHAT WAS THE MOST ENJOYABLE PART OF GETTING TO COMMENCEMENT? Meeting many of the Gulf Stream Avenue neighbors was very enjoyable. Gulf Stream Avenue is a terrific neighborhood. I also enjoyed walking down the sidewalk with you, Ed, and seeing the site with its white shell and fence. That is the prettiest the site will look as construction is an ugly process. SHARE SOME TIDBITS ABOUT THE $50 MILLION PROJECT, THE JEWEL. Well we have 2 miles of concrete and 5 miles of steel below grade. Our 25,000 sq ft of glass will be an amazing design feature with 11’6” of curtain wall glass on both Gulf Stream Avenue corners. It will create quite an impression. Our cabinets and vanities, doors, floors and walls (porcelain products) all come from Italy. WHY DID YOU WANT TO CREATE THE BOOK THE JEWEL BACK IN TIME? The site is such an amazing location with history tying it to the original landing by the Scots. The Jewel site has a historic monument attesting to this fact. The Jewel was waterfront property when the town of Sarasota, Manatee County, was first platted in 1886. As I presented the Jewel project to customers I found it enjoyable to go over the neighborhood history. I ended up utilizing a plat map that Mike Hartenstine of Williams Parker gave me in all my sales presentations. I then decided to jump in and create a large coffee table photo book with captions primarily covering lower Main Street over a 140 year span of time. DO YOU HAVE ANYTHING YOU LIKE TO ADD TO CLOSE OUT THIS INTERVIEW? I look forward to putting on a hard hat with you Ed and going up the buck-hoist to each level as The Jewel pushes skyward.

Some would say it is just that – a business, a commercial enterprise. Others might say it is a transaction business - after all, as Realtors® we get paid only upon successful closing of a transaction, and this is how we measure our personal and business productivity. But what is it really?

I was reading on leadership.

The real estate business serves one of a human being’s most basic needs – the need for shelter. As such, it is important that we realize our business is essentially a people business. As Realtors®, our business success is dependent upon how well we serve our customers before, during and after a transaction.

In order to best serve our customers, we must take the time to get to know them – really know them. Not simply know the kind of home they are looking to buy or sell, but what is important to them, how they make decisions, what is motivating them to make a change, and any concerns they may have. This will involve an investment of time on our part, and we must always be accessible, approachable and empathetic.

As professionals in a competitive market, we constantly strive to differentiate ourselves from others. When a customer asks “What makes you different from other Realtors®?” many of us will say, often without thinking, “It is the high level of customer service I offer”. We then go on to give examples of the service the customer can expect such as our hours of operation, response times to phone calls and other measurements. But what does service really mean? I began to ponder this question as I sat on a nine hours transatlantic flight to London recently. My thoughts were provoked by a book

Listening skills are very important. Really hearing and understanding what is said as well as what may be left unsaid. We are all familiar with the saying that we were given two ears and one mouth, and they should be used in that proportion. The world’s most successful people will tell you they listen more than they speak. As I travel to other countries and talk to people there about investing in U.S. real estate, the biggest criticisms I hear about our real estate professionals are that we talk too much and sell too hard!

Some real estate transactions come about for happy reasons – a wedding, new baby, job promotion for instance. Others are caused by unhappy circumstances: death, divorce, loss of a job. Sensitivity to a customer’s motivation and feelings is paramount. Offering encouragement tempered by practical advice at the appropriate times, will always be welcome and result in lasting customer relationships. At all times, we should be conscious of showing our appreciation for the trust and confidence our customer has placed in us. Not just when they initially award us a listing, or choose us as their agent in a purchase, but throughout that transaction and into the future. Remember to always thank the busy mother for making sure her home shows beautifully shortly after she has delivered three children to school, or the older homeowners who have followed your staging advice and removed lots of their precious family photographs and trinkets. Investing in customer relationships will manifest itself as excellent customer service. Excellent customer service will lead to future business, not only with your customers, but also with their friends, relatives, neighbors and business associates. Remember, without people on both sides of a transaction, there will be no contract, no closing and no commission!

THINKING OF REMODELING YOUR CONDO? By Jay Anderson

It is the time of year when our Florida weather spawns spring cleaning and remodeling projects. Large condominium projects typically occur when a resale purchase is made, while smaller projects, like a kitchen or bath, can occur any time. In a single-family home you are usually inconveniencing one person or a single family, but in a condo, you could be impacting hundreds. Sometimes, though, structural elements or utilities prevent a contractor from being able to redesign the interior as much as you would like. If you live in a condo here are a few items to consider from my years of performing condo renovations. APPROVALS Outside of municipal approvals the building/remodeling process really starts with the condo association. Restrictions vary from building to building, but most associations have policies in place to preserve the overall look and feel of the development. In other words, your condo renovations can’t impact the building’s common spaces or neighboring units. But when it comes to remodeling within individual units, most associations are flexible. Before embarking review your condo association’s rules and regulations. They outline what can (and can’t) be altered in your unit and what permissions are needed. The condo association is interested in preserving the building and making sure proper materials are used. A good example is sound suppression. Sound suppression in the floors isn’t required by code but condo associations mandate it. OCCUPANTS

Most condo associations restrict the hours contractors can work so residents are not disturbed too early, too late or on weekends. Personally I further restrict working hours to be a good neighbor. This ultimately impacts the project schedule but you still want your neighbor to be your friend at the end of the job. A prudent contractor will meet with the owners of the units that surround the one where they will

be working to give them information on the project and to provide contact information, including cellphone numbers, in case there is a problem. MATERIALS When remodeling a condo you are dealing with space constraints. Space constraints create logistical challenges, from staging or storing materials, to the necessity of removing debris from the project each day. Something as simple as reserving and scheduling a freight elevator must be considered. A contractor must strive to have materials delivered at the right time so they can be installed immediately rather than storing them on-site. This presents a challenge for wood flooring or cabinets that need a week or more to acclimate in an air conditioned environment before installation. To cure wood products I maintain my own climate controlled warehouse for flooring and cabinets. Framing materials also come into play since in a condo you are working with noncombustible materials. SUBCONTRACTORS When building or remodeling a home the owner wants to see 30 people working on the job. In a condo, with space constraints, it is the exact opposite with only one or two trades on the job at any time. It starts with parking and material delivery. Limited parking restricts the number of workers. Coupled with limited storage space for material and confined working conditions it is imperative the sub on the job get in, perform their duties and get out, so the next sub can get on with their work. If there is a limited number of guest parking spots (which is typical), you have to make arrangements for contractors while they are working. Communication with the concierge or building manager is paramount to getting workers in and out. Work with your general contractor and understand that a condo remodel will take a little longer, but you’ll be pleased with the end result.

This spring is all about renewal. The transition from winter to spring is particularly exciting as we anticipate the end of colder days. We just experienced the spring forward with daylight savings time. The days are a bit brighter and longer, and pedicures and bare legs are a reality. It’s not hard to get caught up in the heat of the moment and splurge on new spring things for your closet. Spring also feels like a reawakening. This season’s runways offered a series of wake-up calls by way of unique pairings, new approaches to femininity and dramatic looks. I fell in love with the experience of being out on the water on a Stand Up Paddleboard here in Sarasota and wanted to share it with as many people as possible. I knew a Race would be a great way to get a large group of like-minded people together to have some fun, but couldn’t decide on a single location to hold it…So I chose 3. Every person impacted by cancer has a unique story, but invariably, the collective tales follows a similar plot line. “It’s like being thrown into a foreign country where you don’t speak the language,” observes Program Director Andrea Feldmar, LMHC. “The first thing many people feel, aside from panic, is alone.” Processing volumes of information related to everything from blood count, drugs, interactions and reactions, says Andrea, is akin to trying to learn something new while hopping on one foot, blindfolded. “It’s pretty challenging and isolating,” she notes. “That’s what Center for Building Hope addresses. We reduce that overwhelming sense of isolation.” Launched in 1994 as the Wellness Community, Center for Building Hope has evolved into an independently-run 501c3 organization that offers psychosocial support services to anyone – including patients, families and caregivers – dealing with a cancer diagnosis. All services are completely free of charge, and are thoughtfully designed to address an array of issues and needs. “We work as a team with oncologists,” explains Andrea. “Our staff is trained in the mind/body connection, and we focus on empowering our clients with the knowledge and resources they need to make the best decisions they can.” To the surprise of many first-time visitors, Center for Building Hope (CBH) isn’t shrouded in a clinical setting. The sprawling 5-acre Lakewood Ranch campus

is a healing and aesthetically-pleasing environment featuring a Gold LEEDcertified green building and outdoor spaces designed with the unique needs of cancer patients and their caregivers. “We partnered with Ringling College of Design, who provided innovative ideas for our community,” says Andrea. It’s in the details; outdoor areas such as a colorful butterfly garden and serene pond feature ample shade to protect delicate skin impacted by chemotherapy and radiation treatments. A labyrinth acts as a centering tool for those seeking to calm their minds and achieve inner peace. “Time and again, we hear people say, ‘This isn’t what I expected,’” says Andrea. “We’re proud of that.” CBH’s calendar of activities ensures that patients, family members and caregivers have ample opportunities to connect with others. “We make it easy to come and spend the good part of a day here,” Andrea notes. All groups are led by licensed clinicians, and emphasize evidence-based research models. “We don’t promote any specific treatments or services,” she adds. “We simply provide the education and opportunities for people to share their experiences.” Support and networking groups are specific and include communities of men; Spanish speakers; young women diagnosed in their 20s, 30s and 40s; and caregivers. Additional groups focus on grief, nutrition and exercise. Monthly networking meetings are cancerspecific, allowing members to delve into specifics relating to treatments, symptoms

and experiences. In addition to activities at its primary campus, CBH also offers outreach programs throughout the region. With no federal or state funding, the Center for Building Hope runs on grant monies, donations and fundraising dollars. “The generosity of individual donors makes all the difference,” says Andrea. “Committing to ten dollars a month has a tremendous impact on countless lives,” she remarks. CBH has become known for its array of community events, which draw significant crowds and yield critical financial gains. “We have a great calendar of fundraisers, including our annual award-winning gala, Night of Hope.” She continues, “We love the opportunity to partner creatively with local organizations, and have put together events including tennis and golf tournaments, car shows and fashion outings, which appeal to a diverse group of individuals. They have a great time while contributing to a wonderful cause!” Center for Building Hope will continue its mission to help enhance the quality of life for those impacted by cancer for free.

The Nautilus has been revered and studied by mathematicians, biologists, and philosophers for ages. Growing up in construction, Ryan displayed tenacity and drive at an early age. Before he was in high school, he spent summers working on home sites as a laborer. Nepotism wasn’t a factor; he recalls overhearing a conversation in which his father instructed a site supervisor to keep Ryan, then 17 years old, off of a particular project. “During lunch, I went ahead and did the work,” he recalls.

“When my father returned to the site the next day, he was impressed with the craftsmanship and asked who had done the work.” Ryan’s skills were rewarded; he was promoted to a position as a carpenters assistant where he continued to study the art of building homes, and to prove his mettle. At 20 years old, engaged on a project for a high-profile client, Ryan worked his way into a

leadership position when the site superintendent left for vacation. “I asked for the opportunity to manage the project while the super was on vacation,” he says. Father, Richard Perrone, granted Ryan his request, and he reassumed the role he felt equipped to handle. Witnessing Ryan’s dexterity his father ultimately allowed him to complete the home. “It was an impressive project that made the cover of the 20th anniversary edition of Veranda Magazine,”

Ryan says. “That was a turning point for me. That’s when I decided to be a General Contractor.” His attention to detail, unwavering work ethic and passion for efficiency have shaped the course of Ryan’s career and defined Nautilus Homes’ promise to its customers. “We’ve shown, time and again, that you don’t have to settle for a track home that lacks character and individuality,” Ryan asserts. The home building process, he says, can also be a positive one with the right team. “Our concierge approach helps relieve the stressors involved in building a home,” Ryan observes. “It’s not always an easy process. We’re able to adapt accordingly with minimal impact to the project.” Engaging those customers in the process is critical. “We establish expectations, providing our clients with the information they need to keep the project running smoothly,” Ryan explains. “A comprehensive list of items requiring selections, with deadline dates, lets people know exactly when they’ll need to make decisions on details such as countertop materials, flooring and interior colors. This maintains the flow of the construction process and is one system among many we use that allows us to deliver the top-quality product and experience that defines us.”

Client Russell James shares, “We are very pleased with our new home. There are thousands of components that all fit together to make a home. We did not wish to drag this process out over 18 months which would have been easy to do. Our home, start to finish, was one year. To make this happen the builder needs to be working every day, keep their subs focused and communicate with the owners, suppliers, and subs. The Perrone family makes annual visits to Europe and travels to many locations around the world where they reconnect with history and glean design inspiration for future projects.

REAL | perspectives DESIGNER LIABILITY FROM A FORENSIC ARCHITECTS POINT OF VIEW By William Henry, PhD As a forensic architect and court certified expert witness, I am often engaged by both plaintiff and defense counsel to opine on whether an architect has committed errors and omissions that would lead to liability exposure. What actions by architects constitute errors and omissions (E&O) that could lead to damages incurred by property owners, clients, and/or victims of construction site injuries? A TAKE ON ERRORS AND OMISSIONS Prior to attempting to offer up yet another definition of E&O, we need to establish that according to most industry wide standards, a professional architect need not be perfect in rendering his service. Particularly with respect to the delivery of complex building projects, E&O will occur. The best gauge of whether liability can be assigned is whether the design professional used “reasonable care and good professional judgment in the rendering of the service”. Therefore, it is important for consumers, clients, and others ready to assign blame, to consider this interpretation. In many depositions that I have been a party to, there is an unrealistic expectation of what an architect can do and what he can provide in the way of so called product delivery. Architects DO NOT provide and warrant a product. Yet, I have heard countless homeowners, real estate developers, other functionaries and their attorneys state flat out that the architect owed them a perfect product which was theirs to keep. Along with very competent legal counselors we have had the good fortune of serving, we have consistently defeated this position in court proceedings because architects, just as attorneys and physicians, cannot warrant success as an outcome. Case in point, patients die and attorney’s clients go to jail. This outcome does not necessarily constitute malpractice despite what many attorneys who advertise claim. WHEN IS THE DESIGNER LIABLE FOR E&O? There are two forms of liability. One form is simply termed an ‘omission’ of some needed built component of the project whose absence would lead to a deficiency. The omission could be egregious leading to code non-compliance (breach); or relatively minor in that the component could easily be installed later on without impact to cost. a ‘first cost’. This rarely constitutes malpractice. However, the former can lead to liability since the omission may not be easily cured and/ or some of the project work would need to be demolished. This is termed a ‘second cost’ and can lead to serious damages because the cure may not be easily performed and/or have major associated cost impacts. Errors can be simple or serious mistakes in the rendering of the service. When errors are committed involving life safety and code compliance and their consequences find their way into the project construction, claims can often follow. Particularly serious are those code violations which contribute to compromising the protection of the health, safety, and welfare of the general public. If it is discovered because someone becomes injured as a result, then claims and lawsuits will likely ensue.

THE ARCHITECTS ROLE DEFINED In the above proceedings, how is the architect viewed? Plaintiff ’s counsel, who represents the damaged party, will wish to expand the definition of the architect’s role. In short, the architect who acts as a so call “master builder” incurs an expanded liability potential. By contrast, those defending architects will wish to limit the scope of the design practitioner to that of a so called “computer-aided design” operator. Such an architect would ideally never visit the site and would be “blissfully ignorant” of anything beyond what was provided by his client. Which definition is correct? I have searched the Florida State Statues governing professional practice and found no definition of an architects role. The only definition available is a description of the architect’s education (from an accredited educational institution) and licensure by passing various exams (National Council of Architectural Registration Boards ‘NCARB’), and a required period of apprenticeship. This lack of clarity as to the architect’s role has not only left the profession in some turmoil but created a vacuum for attorneys to have a field day. It is very similar to the condition that physicians find themselves in today who would rather limit their expertise to a certain component of the body e.g. knees vs. thigh bones or ankles. The vacuum in both professions has caused the need for paraprofessional generalists. In the healthcare industry so called “coaches or health care advocate” have emerged to coordinate specialists in the event of catastrophic illness. In the design profession, the vacuum has led to the advent of glorified contractors known as ‘construction managers’ (the CM). In filling the voids these interlopers have created more complexity leading to a much more litigious environment.
